C.A.R. Fights to Protect Homeownership: Yes on Prop 5 No on Prop 10

C.A.R.’s efforts to pass Proposition 5 (C.A.R.’s Tax Portability initiative) and defeat Proposition 10 (the initiative that will allow for the drastic expansion of rent control) are in full force.

Please encourage your agents to get involved. C.A.R. has created a Member Toolkit with newsletter articles, talking points, social media content and templates for door hangers, yard signs and other materials. Please urge your agents to use these tools to talk to their clients, family and friends about Prop. 5 and Prop. 10.

Proposition 5, which C.A.R. gathered over 1 million signatures to place on the November ballot, will allow seniors, the disabled and victims of natural disasters to transfer some of their property tax basis.

Proposition 10, which C.A.R. is OPPOSING will un-do the Costa-Hawkins rent control limitations and allow local governments to impose rent control on single-family homes and new construction.

AB 2458 (Weber), C.A.R.’s sponsored parcel tax exemption bill, was signed into law by the Governor.
 Existing law allows for the imposition of parcel taxes, which are special taxes assessed on individual pieces of property, to fund, among other things, education. Under current law, school districts may exempt seniors and severely disabled individuals, who are typically on fixed incomes, from paying parcel taxes. Unfortunately, many senior and severely disabled homeowners are unable to find information on how to apply for a parcel tax exemption. This measure will assist homeowners in applying for a parcel tax exemption by providing the information on the county’s website.

AB 3041 (Cunningham), C.A.R.’s sponsored legislation on banning private transfer fees, was signed into law by the Governor. Private transfer fees (PTFs) are fees imposed by a seller requiring the buyer and any subsequent purchaser to pay a fee upon the transfer. For Fannie Mae and Freddie Mac backed mortgages, the Federal Housing Administration (FHA) and the Federal Housing Finance Agency (FHFA) require that the funds generated by PTFs provide a “direct benefit” to the encumbered property. This measure will ban private transfer fees that do not comply with these requirements.
