C.A.R. is proud to have sponsored and supported four major bills which were signed by the Governor that further the goal of fair housing. These bills will reduce discrimination in housing and help ensure the dream of homeownership can be a reality for more Californians. These bills include our sponsored bills AB 491 (Ward & Gonzalez) and SB 263 (Rubio); and supported bills AB 948 (Holden) and AB 1466 (McCarty).

 

Sponsored Bills

 

AB 491 (Ward & Gonzalez) Eliminates Discrimination in Mixed-Income Multifamily Housing

Current law allows for the construction of a mixed-income multifamily structure in which the occupants of the affordable units do not have the same access to the common entrances, common areas, and common amenities as the occupants of the market-rate units. AB 491 prohibits this discriminatory housing practice.

 

Status: Signed into law September 28, 2021 (Chapter 345, Statutes of 2021)

SB 263 (S. Rubio) Implicit Bias Training for Real Estate Licensees

This law requires all real estate licensees to have implicit bias training, as part of their DRE license renewal requirements, and makes the current mandated fair housing training more robust and relevant. SB 263 will go into effect on January 1, 2023.

Supported Bills

AB 948 (Holden) Appraiser Discrimination

AB 948 requires a purchase agreement in a real estate transaction to inform a seller and buyer of the opportunity to report, through the Department of Consumer Affairs’ internet website or telephone number, any suspicion of a discriminatory appraisal by the holder of a real estate appraiser license. Furthermore, it requires such a notice to be provided by a lender when a buyer is applying for a loan. Finally, AB 948 will make changes to the Fair Employment and Housing Act        to apply the Act to refinancing transactions and appraisals. C.A.R. staff was involved in working with the author’s office to help make AB 948 effective and, at the same time, ensure it does not delay real estate transactions.

AB 1466 (McCarty) Racially Restrictive Covenants

AB 1466 creates a process to facilitate and accelerate the redaction of racist language from housing documents when property changes hands. C.A.R. worked with the Author to ensure the process would not adversely affect or delay real estate transactions.
