What is one piece of advice you often share with parties entering mediation?

Come with an open mind and flexibility.  Be realistic and collaborative.  Also since I am an expert in this area of the law you don’t need to spend a lot of time in your briefs explaining the law. Focus on the facts and persuasive arguments to convince your opponent.

How do you approach building trust with the parties during mediation?

Patience and empathy.  I spend time with the parties to let them explain their positions, interests and concerns.

Can you share a lesson you’ve learned from your years of mediating disputes?

It is a much better alternative than the uncertainty of litigation.  Also people need to be heard so they will consider alternatives. Finally, making unrealistic and unsupported demands just prolongs the process.

How do you stay calm and objective during challenging cases?

Breathing. Using active listening, patience, metallization (i.e. understanding the parties state of mind), and using humor when appropriate.
