An industry article was recently published about the use of C.A.R.’s Standard Forms by unauthorized software providers. C.A.R.’s real estate forms are the “gold standard” in California real estate. Our forms are developed with REALTOR® input to create forms that best meet the needs of its members. Here’s how C.A.R. protects its members in the development of its forms:
C.A.R. has always focused on protecting its members and will always do everything possible to protect the forms and their usage for the benefit of California REALTORS®. Protecting the forms assures that a member can rely on C.A.R. forms created in zipForm® by another agent in the transaction. The member can be sure the form is one that they know and understand. They can be sure that C.A.R.’s User Protection Agreement stands behind the forms created in zipForm®. Imagine if forms are changed and all parties have to go to individual attorneys just to compare offers.
C.A.R. makes the most-current version of its forms available through zipForm® in a secure, reliable manner that maintains the integrity of the documents and data. C.A.R. spends considerable amounts of time and resources, including members’ valuable time and insight, to ensure the usefulness, accuracy, and completeness of the forms. They are designed for trained real estate professionals and must be protected from unauthorized copying.
C.A.R. unapologetically protects its forms by distribution through a software company with high quality controls. C.A.R. values the ability to control privacy, the right of REALTORS® to control where the data flows (it belongs to the brokers, after all), security of the data, and the integrity of our forms. Unlike other software companies, zipLogixSM would never share the personal information that is contained in our forms with the public or post such information anywhere that would put our members or their clients at risk. Unlike C.A.R. and zipLogixSM, some other providers don’t have any interest in protecting REALTORS®’ rights to their data, even data about consumers.
As our members expect, C.A.R. does everything in its power to protect its forms, which is why we do not allow our valued forms to be used on platforms that may not have adequate security or privacy protection. Additionally, some of these platforms do not use the incredibly important e-signature protections of zipLogix Digital Ink® or DocuSign®. Overlooking these critical issues actually will hamper adoption of cutting edge technologies and the efficiencies associated with a totally paperless transaction, not to mention create risk management concerns for our members by putting their transactions at risk.
C.A.R.’s policies are ultimately determined by its directors, more than 800 California real estate professionals. A couple of real estate agents were interviewed for the article and expressed their discontent with C.A.R.’s policies. As with any decision, C.A.R., through its member directors, makes decisions about products and services that strive to benefit the membership.
REBS®’ and zipLogixSM’s loyalties are to the C.A.R. membership. California REALTORS® are always foremost in the decisions that are made concerning forms software. Having a CEO that is duty bound to maximize profits without any allegiance to the real estate professionals and industry would be the real conflict. In addition, contrary to firms that are angling to go public or simply line private venture capital pockets, zipLogix is owned by REALTOR® Associations and all profits go right back to support the members. It assures that the members' interests are first, and that short term gains will not trump the interests of the real estate industry these Associations serve.
Protecting the integrity of the real estate transaction, through state-of-the-art forms comes with some restrictions, and we are committed to continuing to make sure the transaction is safe, reliable and minimizes tampering, privacy breaches, and other risks for our members.
