FORM and RECOMMENDATIONS
CTT
The area on the CTT form that generates problems is the box labeled "Tenant
Consent to Extension or Renewal of Lease". It is unclear what the
intent of the Standard Forms Committee was in creating this section of the
form. It appears this form is utilized primarily to increase rents and/or
security deposits only, not for purposes of extending or renewing the
lease. Tenants are signing that portion of the form thinking that by doing
so they are renewing the lease. Most property managers utilizing this
form are crossing out this section so tenants can’t sign it.
Can we eliminate this box?

As to all forms with a "Delivery of Notice" provision; a "Proof of Service"
check box should be added to accommodate attachment of a "Proof of Service"
Form. Can "Blanks" be added, appropriately labeled, to permit
filling in the date, time, place and name of person who served the
notice.

1) D. Payment Section, in
Section 3. "RENT": Can this Section be clarified for an "easier
read" and to also indicate that certified or cashier's checks can be
required in lieu of cash?
2) In paragraph 10, can any "teeth" be placed in the Requirement to
return the MIMO?
3) In paragraph 40. ATTORNEY FEES. Can these fees be "capped" to
help restrain tenants' requests for jury trials?
LRA
1) Can a request for Age/DOB information be added, with a
disclaimer that it is for "identification purposes only", or would
it still be considered a violation/discriminatory issue/question?
2) Can a "Fair Credit Reporting" Notice be included in
LRA, in the appropriate place of the Form that states:
In compliance with the fair credit reporting laws, you are
advised that a screening will be conducted regarding the information
listed on this application and your character, general reputation and
rental history. By P.O. Box 2826, Seattle, WA 98111, to obtain credit
reports, rental and employment verification, bank information and character
information as necessary. MOCO, Inc. is authorized to release any
information obtained during the screening process to landlord and
landlord’s agents. Applicant has the right to dispute the accuracy of
information obtained during the screening process. If the application
is denied because of credit, applicant may obtain a copy of the
credit report from the credit reporting agency. I/we certify that to
the best of my/our knowledge all statements are true and complete.
False, fraudulent or misleading information maybe grounds for denial of
tenancy or subsequent eviction.
3) Can a separable "Application Denial" Form be attached as an
addendum to this form?

Can the phrase "Buyer Representation
Agreement" be deleted and replaced by a blank line that can be
filled in with any agreement that is not a "Listing Agreement", in
Paragraph 1and before the signature section, making it a more universal
form?

and "B" can the "the following" be stricken so as not to
require specificity in advance?

after "cash" can the option of "cashiers or certified check" be
added?

lines be added to permit a more detailed description of required

1) Can we revisit the need for a
separate property management agreement form for HOAs? This would
be a separate form from the PMA utilized for property (either commercial or
residential) that is being leased/rented and managed.
2) Can a separate PMA form be created for short-term, vacation-type
rentals?

In paragraph #1 of the
"Notice to the above-named Person(s)…" section, can all of the
"$__for the period__ to___" lines be eliminated and simply have a
single "from" line and a single "to" line with a "total delinquent" line
for the summation of all past due rents AND a single line for "total
monthly rent"?

Can we add tenant and landlord
provided "check boxes" for all basic amenities such as appliances
and other personal property included, parking, storage, utilities, and "who
pays for what services"…?
GENERAL QUERIES
1) It is recommended that "landlord" and "tenant" options for
assignment of responsibility be added to the mix of forms that currently
apply only to "buyer" and seller". Such forms as that for Lead
Paint Disclosure, Water Heater Strapping, Smoke Detector Requirements, etc.
Could the "Seller's Questionnaire" be re-titled as the
"Seller/Landlord" Questionnaire?
2) Can all the disclosures currently done on separate documents be
compiled into a single booklet for distribution to tenants?
