the Housing Committee Mission Statement, has NOT been approved by the
Housing Committee, Strategic Planning Committee, Executive Committee or the
Board of Directors. It is a "living" document subject to revision of Issue
Area mission statements as policy considerations require.

Status/Summary
The Board of Directors adopted a recommendation of the Public Policy
Reorganization Task Force in 2009 to create a more efficient policy and
legislative body in C.A.R. The Task Force was created out of concern that a
proliferation of C.A.R. policy committees impaired the efficient
functioning of the process and was fostering an environment of committees
that were duplicative and too narrowly focused. The Reorganization Task
Force met extensively during 2008 and early 2009. Its recommendations were
ultimately adopted by the C.A.R. Board of Directors in January of 2009,
resulting in creation of the Housing Committee with the mission statement
noted below. All issues covered by each Committee will be addressed by that
committee as a whole. Issues Chairs, in the order designated by the
Committee Chair, will lead the discussions on issues within their
respective areas.
The Housing Committee is a Policy Committee. Its mission is to develop
C.A.R.'s housing policy. It has original jurisdiction to evaluate housing
legislation and regulation in the following issue areas: Common Interest
Developments; Fair Housing/Equal Opportunity; Housing Policy; Manufactured
Housing; Multifamily Housing; Property Management; and Real Estate
Finance.
Housing Committee issues areas mission statements
I. Common Interest Development - Common Interest
Development issues include policy decisions regarding representation of
buyers and sellers of separate interests in common interest developments
(CIDs); managing the CIDs through home owner associations (HOAs); educating
HOA boards of directors regarding fiscal solvency of HOAs; and appropriate
levels of regulation for CIDs. This issue area includes, but is not limited
to, such topics as:
- The Davis Stirling Act
- Agent access
- HOA management
- Conversions
- Rights of CID unit owners
II. Fair Housing/Equal Opportunity - Fair Housing/Equal
Opportunity issues include policy decisions regarding discrimination in
housing, equal access to affordable home ownership for all California
citizens, creation of additional availability of housing that provides
accommodations without arbitrary discrimination based upon race, color,
religion, sex, sexual orientation, marital status, national origin,
ancestry, source of income, familial status, age, or disability. This issue
area includes, but is not limited to, such topics as:
- The Unruh Act
- Legal remedies for victims of housing discrimination
- Americans with Disabilities Act (ADA)
III. Housing Policy - Housing Policy issues include policy
decisions regarding affordable home ownership for the workers in
California, including the progression from rental housing to ownership
generated by new construction, rehabilitation, and redevelopment; avoidance
of restrictive regulatory policies; and encouragement of governmental
actions such as flexible zoning, innovative local planning, cooperative
public-private projects, density bonuses, mixed use developments, land
trusts, down payment assistance programs and shared equity arrangements.
This issue area includes, but is not limited to, such topics as:
- Inclusionary zoning
- Second units
- Housing element
- Density Bonus
- "NIMBYism"
- Workforce housing
IV. Manufactured Housing - Manufactured Housing issues
include policy decisions regarding manufactured housing financing;
representation of buyers and sellers of manufactured homes and owners of
mobile home parks and manufactured housing communities; and regulation of
mobile home parks and manufactured housing communities. This issue area
includes, but is not limited to, such topics as:
- Park and community conversions
- Specialized financing issues
- Earthquake bracing
- Construction standards
- Manufactured housing community/mobile home park rent control
V. Multifamily Housing (More than 4 residential units in the
complex or development) - Multifamily Housing issues include
policy decisions regarding availability of multifamily housing for
veterans; occupancy guidelines for multi-family properties; representation
of buyers and sellers of multi-family properties; and increasing
development opportunities for multi-family properties.
This issue area includes, but is not limited to, such topics as:
- Subsidized housing programs
- Development programs
- Occupancy ratios
- Substandard housing
- Affordable housing
VI. Property Management - Property Management issues
include policy decisions regarding protecting rights of rental property
owners such as the right to exit the business as provided by the Ellis Act;
opposing restrictions on returns of investment in rental property;
increasing the availability of rental housing in housing-short areas of the
State; and establishing an affordable housing environment that begins with
rental housing and culminates with home ownership. This issue area
includes, but is not limited to, such topics as:
- Security deposits
- Landlord/tenant relations
- Costa Hawkins
- Rent control
- Termination of tenancies
VII. Real Estate Finance - Real Estate Finance issues
include policy decisions regarding housing tax credits; home loan
modifications; foreclosure prevention; enhancement of home financing
processes; increasing availability of home financing options; and general
protection of the availability of funding for home loans. This issue area
includes, but is not limited to, such topics as:
- Secured lending regulations
- Predatory lending
- FHA/VA Loans
- Foreclosures
- Credit scores
- Down payment assistance
- Shared equity arrangements
- HVCC
