The following is a summary of the significant action items approved by the
CALIFORNIA ASSOCIATION OF REALTORS® Board of Directors at its October 2003
meeting. Some additional information items are included, but do not

Award Selection
1. To approve the selection of Annette Graw, South Bay, as the recipient of
the 2003 California Distinguished REALTOR® Award, the highest recognition
that C.A.R. can bestow on a member.
C.A.R. Scholarship Foundation
1. It was reported for information only that funds were awarded for
scholarships totaling $6,500, and that a fund established in honor of
former C.A.R. President, and current N.A.R. President-Elect, Walt McDonald
has exceeded $10,000 in contributions.
California REALTOR® EXPO Advisory
1. It was reported for information only that total attendance at the
California REALTOR® EXPO was approximately 8,800.
Common Interest Development
1. That C.A.R. "SPONSOR" legislation that would:
-- Require community service organizations to provide annual financial
disclosure statements to homeowners.
--Prohibit homeowner associations from charging fees higher than their
actual costs to copy documents in connection with the transfer of
title.
-- Require homeowner associations to disclose how and when they shall
adequately fund their reserve accounts
Requirehomeowner associations to utilize qualified entities in the
preparation of reserve studies.
2. That C.A.R. "SUPPORT" legislation that would permit existing stock
cooperatives to convert to a condominium.

Equal Opportunity - Cultural Diversity
1. That C.A.R. take an "AGAINST" position on the October 2003 Ballot
Proposition 54, which prohibits state and local governments from
classifying any person by race, ethnicity, color, or national origin.
Housing Affordability
1. That C.A.R. "OPPOSE" AB 980 (Salinas), a bill that would permit local
governments to self-certify their housing elements and would imposeresale
price restrictions and rent control on at least one-third of the housing
produced.
2. That C.A.R. "SPONSOR" legislation that would permit developers or
property owners to place a duplex (each unit may be separately owned) on
corner lots within newly created subdivisions.
3. That C.A.R. "SPONSOR" legislation exempting planned unit developments
that comply with local development standards and CEQA from conditional use
permits.
4. That C.A.R. "SPONSOR" legislation granting additional fair-share housing
credits and priority for certain state programs (e.g. water and sewer
bonds) to local governments that promote new or add to existing a)
first-time homebuyers b) multi-family developments, or c) mixeduse
developments.
5. That C.A.R. "SPONSOR" legislation permitting local governments to
increase the number of density bonus units and reduce the number of years
units are subject to price restrictions.
Housing Affordability Fund
1. That C.A.R. allocate matching funds to the Housing Affordability Fund as
of December 31, 2003, in an amount equal to contributions collected by HAF
(excluding C.A.R.'s initial contribution) and not to exceed $500,000.

1. That,
subject to N.A.R. approval, C.A.R. Model MLS Rule 7.22 be amended as set
forth below:
7.22 Dual or Variable Rate Commission Arrangements. The
existence of a dual or variable commission arrangement shall be disclosed
by the listing broker by a key, code or symbol as required by the
MLS. A dual or variable rate commission arrangement is one in which
the seller or owner agrees to pay a specified commission if the property is
sold by the listing broker without assistance and a different commission if
the sale results through the efforts of a cooperating broker, or one
inwhich the seller or owner agrees to pay a specified commission if the
property is sold by the listing broker either with or without the
assistance of a cooperating broker and a different commission if the sale
results through the efforts of a seller or owner. The listing broker
shall, in response to inquiries from potential cooperating brokers,
disclose the differential that would result in either a cooperative
transaction or, alternatively, in a sale that results through the efforts
of the seller or owner. If the cooperating broker is representing
a buyer or tenant, the cooperating broker must then disclose such
information to his or her client before the client makes an offer to
purchase or lease.
2. That, subject to N.A.R. approval,C.A.R. adopt the proposed Virtual
Office Websites (VOW) rules and changes to existing rules into the C.A.R.
Model MLS Rules as set forth
in Attachment
A.
Political Affairs
A drawing was conducted to determine a winner from among 2003 political
action fund contributors. The drawing winner was Sheila Duke, who won
two plane tickets anywhere in the continental US and $1,000.
Political Fundraising Awards were presented to the following individuals
for their efforts in bringing in additional political action fund
contributions.
Barbara Delgleize -- 61 contributors for $ 12,017 ( Barbara won 2 plane
tickets anywhere in the continental US and $2,000)
Candice Carpenter -- 47 contributors for $9,259 (Honorable Mention)
Marty Samuel -- 38 contributors for $7,486 (Honorable Mention)
Property Management
1. That C.A.R. "SPONSOR" legislation that permits property owners of
residential income property in rent control communities to convert their
property to a condominium if a majority of the tenants agree to purchase
their units, and if the remaining tenants who do not purchase their units
continue to be protected by local and state law.
Real Estate Business Services
1. That the following slate of nominees for a two-year term on the REBS
Board of Directors be approved, and that the C.A.R. President be instructed
to elect these individuals on behalf of C.A.R.

3. To approve a 2004-2006 strategic plan and 2004 budget with the following
criteria:

98 budgeted C.A.R. staff positions.
Membership dues, including $115 for operating programs, $10 for the
Political Activity Fund and $10 for the Issues Action Fund, are set at a
total of $135 per member (predicated on 2004 year end membership of
144,000).
A 2004 Capital Budget (funded with Association reserves) totaling $388,600
4. To approve for members in areas not serviced by local associations an
additional $30 in membership dues. This amount would be in excess of the
dues approved for members coming through the local associations.
5. That C.A.R. prorate C.A.R. dues for new members on a monthly, rather
than quarterly basis. (Note: The local association dues can be prorated as
determined by the local associations.)
6. That funding for Past C.A.R. Presidents attendance at C.A.R. Directors
Meetings, predicated on confirmation of participation, will be set at
$1,100 per Past President per meeting at a budgeted cost of $40,000 for
2004.
7. To approve a 2003 budget augmentation with the following criteria:
A. To approve additional cost for the leadership conference scheduled for
December, 2003 in the amount of $20,000
B. To approve a capital expenditure for an additional server totaling
$16,000
C. That $296,000 be approved to provide an additional 4% pension
contribution to the C.A.R. and R.E.B.S. employee pension plan, augmenting
the previously approved budget of 10%.
8. It was reported for information only that the Risk ManagementAdvisory
Committee and the REALTOR® Consumer Protection Forum would be combined, and
that the new forum would be named the REALTOR® Risk Management and Consumer
Protection Forum.
Taxation
1. That C.A.R. take an "AGAINST" position on the Budget Accountability Act,
or any other measure, which would allow the state budget and budget-related
tax measures to be approved with a 55% majority rather than the current
2/3-majority.
2. It was reported for information only that C.A.R. would continue to
"SUPPORT" AB 1338 (Chavez), rather than sponsor legislation. AB 1338
would provide relief from the 3-1/3% withholding for individuals.
