III. Manufactured Housing LegislationA. AB 1469 (Negrete McLeod) Park Manager Educational Requirements – This bill establishes minimum educational and training requirements for mobilehome park managers beginning in January 2008. The bill was recently amended to exempt real estate licensees and common interest development managers from these additional educational requirements, thus removing C.A.R.’s opposition. C.A.R Position: WATCH FILE. Status: Senate Transportation and Housing Committee.B. AB 2106 (Lieber) Mobilehome Park Management Prohibited from Attending Park Resident Association Meetings – This billwould prohibit a park owner or manger from attending or monitoring a meeting of a mobilehome park residents association unless specifically requested to by the residents. For example, it gives residents the right to hold a homeowner’s association meeting in the park clubhouse and demand that management leave, even if the manager’s office is within the clubhouse. C.A.R. Position: WATCH. Status: Assembly FloorC. AB 2250 (Coto) Mobilehome Inspection Program – This bill is sponsored by the Western Mobilehome Park Owners Association (WMA). It removes the sunset from the Mobilehome Park Inspection program, which permits the inspection of mobilehome parks and mobilehome units within a park for code enforcement violations and unsafe conditions. It is similar to SB 105 (Dunn) of 2005, which was passed by the Legislature but vetoed by the Governor, due to an increased annual fee. AB 2250 maintains the existing $4.00 annual fee, which was first established 7 years ago. Many stakeholders would like to increase this fee to $6.00 annually but are fearful of another veto by the Governor. See also SB 1241 (Dunn). C.A.R. Position: FAVOR. Status: Assembly Appropriations Committee.D. AB 2374(Umberg) 60-day Notice for Park Fee Increases – This bill is sponsored by the Golden State Mobilehome Owners Assocation (GSMOL). As introduced, it would prohibit park owners from increasing fees or charges until they have given residents 60-days written notice of the increase. It was recently amended to 1) exempt gas and electricity charges from the 60-day requirement and 2) provide 60-day notice when management has been given 90-days written notice of a fee increase, and 3) if management is given between 60 and 90-days written notice of a fee increase, they can give residents 30-days notice before passing on the increase. AB 2587 (Liu) Meth Lab Cleanup – Last year, C.A.R worked diligently on AB 1078 (Liu and Keene) which established methamphetamine contamination local response protocols for cleanup of methamphetamine labs on private property. However, AB 1078 exempted manufactured housing since there were numerous logistical difficulties that exist if the land and the manufactured home are owned by two separate individuals. This bill, sponsored by Western Mobilehomeowners Association (WMA), would apply provisions of the Methamphetamine Contaminated Property Cleanup Act to mobilehome parks, manufactured housing, and recreational vehicles. This bill clarifies, in cases where a methamphetamine laboratory is in a manufacture home, the landowner is not automatically liable for remediation of any methamphetamine laboratory-related contamination. If an innocent landowner is found to be liable for remediation, the landowner can be reimbursed. C.A.R Position: FAVOR. Status: Assembly Housing and Community Development Committee.F. SB 1231 (Dunn) Mobilehome Inspection Program - This bill would remove the sunset on the Mobilehome Inspection program, which is scheduled to sunset on January 1, 2007. It is similar to SB 106 of 2005, which was vetoed by the Governor because it raised the $4.00 annual fee to $6.00. As introduced, the bill would have authorized mobilehome resident owners to use licensed general contractors to verify home code compliance pursuant to the Mobilehome Residency Law however that provision was stricken from the bill. Report on Mobilehome Community Development in Los Gatos, California – The committee will hear a presentation on Creekside Village, a new mobilehome community development in Los Gatos, California.V. Manufactured Housing on Approved Foundation Systems: Issues in Lake County – Committee member Larry Heinewill report on recent manufactured housing issues in Lake County that his Association has discussed with a local citizens group.VI.
