1 Level I -- Broker participants of MLSs electing Level I are eligible to submit listings to all other Level I signatories and to check out lockboxes for placement on those listed properties reciprocated to that other MLS. By placing a listing in another MLS through a reciprocal agreement, the listing broker is offering compensation to all the participants of the other MLS. However, it does not entitle that listing broker to look at the listings in the other MLS or to automatically be entitled to compensation on offers made on properties that are listed in the other MLS.
EXAMPLE:
Broker A belongs to MLS A but not to MLS B. Both MLS A and MLS B have
signed on to Level I of the Master Reciprocal. Broker A wishes
to put a listing in MLS B and “recips” it to MLS B. All brokers in
MLS B may make bring offers on Broker A’s listing and if successful, Broker
A owes them a commission. However, if Broker A sees a
property on a public web site that happens to be listed in MLS B and wishes
to make an offer, Broker A must individually negotiate a commission as
there is no offer of compensation from brokers in MLS B to all brokers in
MLS A.
2 Level II -- In addition to Level I access, participants
and subscribers (through their participants) of MLSs shall be eligible to
purchase MLS books and comp books of other Level II signatories in
accordance with the terms of this agreement. Since most MLSs no
longer offer hard copies of MLS books, Level II is largely inapplicable
beyond what is available through Level I.
3 Level III -- In addition to Level I and Level II
access, participants and subscribers (through their participants) of MLSs
are eligible to have access to the databases of other Level III signatories
in accordance with the technology and security requirements of each
reciprocating MLS. The compensation rights under Level III are
as if the participants are in the same MLS.
4 Level LB (Lockbox) -- Participants and subscribers are eligible to check out lockbox keys of other signatories in accordance with local Association procedures and in accordance with the terms of this agreement. Level LB (Lockbox) may be selected in addition to any of the other levels. This allows brokers not only to place the local box on the property listed in the other MLS’ jurisdiction but also to have their lockbox programmers/keys activated, even if on a temporary basis, in order to show properties in the other MLS’ area.
